RENTAL AND CANCELLATION CONDITIONS


Encina 29 – Santa Rosalia Lake & Life Resort

Torre Pacheco Murcia, Spain


Article 1 – Definitions

1.1 Landlord: Encina 29, operator of the holiday home located at Santa Rosalia Lake & Life Resort, Murcia, Spain.


1.2 Tenant: The natural person making the reservation and who is a contracting party.


1.3 Rental Agreement: The confirmed reservation including these conditions.


1.4 Property: The holiday home Encina 29 including inventory and accessories.


Article 2 – Formation of Agreement

2.1 The rental agreement is formed after written confirmation of the reservation by the landlord.

2.2 By confirming, the tenant agrees to these conditions.


2.3 Changes or deviations are only valid if confirmed in writing by the landlord.


Article 3 – Cancellation by Tenant

3.1 Cancellation must be made in writing at all times. 3.2 In the event of cancellation, the tenant owes the following amounts:


• Within 5 calendar days after reservation: free cancellation

• Up to 6 weeks before arrival: 30% of the rental sum

• Up to 4 weeks before arrival: 60% of the rental sum

• Up to 2 weeks before arrival: 80% of the rental sum

• Within 2 weeks before arrival: 100% of the rental sum

3.3 Failure to arrive within 24 hours without notification is considered a cancellation without entitlement to a refund.


3.4 In the event of early departure or late arrival, no refund will be given.


Article 4 – Force Majeure and Dissolution by the Landlord

4.1 In the event of force majeure, the landlord is entitled to dissolve the agreement in whole or in part without liability for damages.


4.2 Force majeure includes, but is not limited to: war, government measures, natural disasters, strikes, extreme weather conditions, failures in utility services, or other circumstances beyond the landlord's control. 4.3 In the event of termination due to force majeure, rent already paid for unused days of stay will be refunded within 30 days.


Article 5 – Changes and substitution

5.1 Changes are possible up to 30 days prior to arrival and only after written approval.

5.2 The modified reservation may not result in a lower rental amount.

5.3 Substitution is permitted only after written permission from the landlord.

5.4 Until confirmation, the original tenant remains fully liable.


Article 6 – Liability

6.1 The tenant is fully liable for damage caused by himself, fellow travelers, or permitted third parties.

6.2 The tenant indemnifies Encina 29 against claims from third parties arising from the use of the property. 6.3 Encina 29 is not liable for:


• Theft, loss, or damage to personal property

• Injury sustained during the stay

• Disruptions to internet, utilities, or resort facilities

• Nuisance or external circumstances beyond its control

6.4 Any liability of the landlord is limited to a maximum of the amount of the paid rent.


6.5 Liability for indirect damage, consequential damage, or lost income is excluded, except in cases of intent or gross negligence.


Article 7 – Statutory Tourist Registration

7.1 According to Spanish law, the landlord is obliged to register all guests with the competent authorities.


7.2 The tenant is obliged to provide all requested identification details completely and correctly prior to arrival.


7.3 In the event of non-compliance, access to the property may be refused without the right to a refund.


Article 8 – Privacy and Data Processing

8.1 Encina 29 processes personal data in accordance with the General Data Protection Regulation (GDPR) and Spanish law. 8.2 Data is processed exclusively for:


• Execution of the rental agreement

• Statutory registration obligations

• Administrative and financial processing

8.3 Data is not retained for longer than legally necessary.


8.4 The Tenant has the right to access, correct, and delete personal data via: info@encina29.com


Article 9 – Applicable law and competent court

9.1 This agreement is governed exclusively by Spanish law.


9.2 Disputes shall be submitted exclusively to the competent court in the province of Murcia, Spain, unless mandatory legal provisions prescribe otherwise.


9.3 If any provision proves to be invalid, the remaining provisions shall remain in full force and effect.
